1. scope and conditions of application

These general terms and conditions of sale apply to all orders placed on the ZenSpire.fr website.
 

ZenSpire® reserves the right to modify these general terms and conditions of sale at any time. In this case, the general terms and conditions of sale in force at the time of the order will apply.
 

Any customer who has placed an order on ZenSpire.fr is considered to have de facto and unreservedly accepted the general terms and conditions of sale in force.

2. product overview

ZenSpire.fr cannot be held responsible for any errors in product descriptions. Photographs are not contractually binding.

3. product availability

Our products are offered while stocks last and to order according to the chosen options and the product.
 

In the event of a stockout on one or more items in your order, ZenSpire.fr undertakes to notify you by email or phone as soon as possible.

4. product prices

The prices of our products are expressed in euros and include all taxes (TTC). They may be modified at any time and without prior notice. Products will always be invoiced at the rate in effect at the time of the order.

5. order

You can place your order on the ZenSpire.fr website.
 

An order is considered placed on ZenSpire.fr and the general terms and conditions of sale accepted as soon as you have clicked on the "Yes, I confirm my payment" or "I pay by bank transfer" buttons.
 

The data recorded by ZenSpire® and our secure payment provider constitute proof of the nature, content, and date of the order.
 

In case of unavailability of the ordered product, the customer will be informed as soon as possible. They will then be offered the choice to modify their order or cancel it.
 

Zenspire.fr reserves the right to refuse to honor an order from a customer who has not paid for all or part of a previous order or with whom a payment dispute still exists.

6. payment

You can pay for your order by different methods:

• Credit card (Carte Bleue, Visa, Mastercard),
• Bank transfer,
• PayPal

Until a product has been paid for in full, it remains the property of ZenSpire®.

7. shipping and delivery

All our deliveries are sent via tracked Colissimo by La Poste for small parcels and by our carrier for furniture. ZenSpire® commits to dispatching orders within 48 working hours (subject to product availability) following receipt of your payment. You then need to add the delivery time by La Poste, generally 48 to 72 hours via Colissimo.

In case of impossibility (out of stock...), the customer will be notified as soon as possible.
 

In the case of an order containing products with different shipping times, the shipping time for the order will be that of the product with the longest shipping time, unless the buyer provides specific instructions. ZenSpire® reserves the right, in this case, to split shipments.

Delivery takes place at the delivery address specified during the order placement.
 

ZenSpire® cannot be held responsible for a delivery delay, as it is dependent on an external service provider. Any incorrect or missing, and necessary, information in the delivery address and customer identity releases ZenSpire® from responsibility for the delivery.
 

ZenSpire® cannot be held responsible for the non-delivery of a product that is out of stock, unavailable, nor for any case of force majeure. ZenSpire.fr therefore declines all responsibility for any indirect damage: loss of business, loss of profit, loss of opportunity, damages, costs...

Shipments to overseas departments and territories (DOM-TOM) require special transport procedures, including the involvement of a freight forwarder at the buyer's expense for heavy and/or bulky products. In this case, ZenSpire® reserves the right to inform the buyer, who will decide whether or not to maintain their order.

All our devices come with a 2-year warranty.

9. claims and returns

The customer can return their purchase within 100 days and will be reimbursed within 30 days of receipt of their shipment, provided that the product is in perfect condition and complete.

10. right of withdrawal

In accordance with the provisions of Article L.121-16 of the Consumer Code, you have a period of fourteen clear days from the delivery of your order to return the delivered item for exchange or refund. However, the following conditions must be met:
 

• products must not have been unpacked

• shipping costs are the responsibility of the buyer

11. sale abroad

The products we sell comply with French legislation. However, ZenSpire® cannot be held liable in the event of non-compliance with the legislation of a foreign country where the products are delivered. It is the customer's responsibility to check with local authorities whether the products or services they wish to order can be imported or used.

12. personal data – privacy policy

12.1. introduction

Transparency being a core value for ZenSpire®, it attaches the utmost importance to respecting the User's privacy and, in this regard, complies with the provisions of the French Data Protection Act no. 78-17 of January 6, 1978, in its current version, and Regulation (EU) no. 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such Personal Data (the GDPR).

12.2. Confidentiality of personal data communicated to ZenSpire®

ZenSpire® attaches the utmost importance to the confidentiality of Personal Data. As such, ZenSpire® takes all necessary precautions to preserve their confidentiality and declares to be in contact with trusted subcontractors, known for the seriousness of their services and the high degree of protection they grant to the confidentiality of Personal Data.

12.3. Right of access, objection, and rectification

In accordance with Article 13 of the GDPR, the User is informed that they have the right to access, object to, rectify, port, delete, and determine the fate of their Personal Data after their death (Articles 15 et seq. of the GDPR).

They can exercise their rights by contacting ZenSpire® Customer Service by postal mail sent to the address provided in the available legal notices, or electronically at pro@zenspire.com, provided they have justified their identity by attaching a copy of their valid identity document to their request and by using the email address provided when registering on the ZenSpire.fr website.

The user also has the option to lodge a complaint with the CNIL in accordance with Article 77 of the GDPR. For security reasons and in case of doubts about the value and authenticity of the supporting documents provided by the User, ZenSpire® reserves the right to request any other supporting document from them. In the event that the User requests to object to the processing of their Personal Data, the User may be asked to close their Personal Account (in the event that ZenSpire® is unable to provide the services concerned without the processing in question).

12.4. Personalized offers and sales prospecting suggestions

The Services are designed to best meet User needs, and ZenSpire.fr insists on providing them with Services with complete transparency and in compliance with applicable legislation.
 

In this context and in compliance with the conditions set out in Article L. 34-5 of the French Post and Electronic Communications Code and the provisions of the aforementioned Data Protection Act, based on the Personal Data processed by ZenSpire®, the User is informed and accepts, from their first use of the ZenSpire.fr website, to receive commercial recommendations, via links accessible through emails or documents that will be sent directly to their email address, in order to benefit from offers for similar or complementary products.
 

The User is also informed that they can at any time object to the use of their Personal Data for prospecting purposes by sending an email to the following address: pro@zenspire.com.

The User's Personal Data is used solely by ZenSpire® for the ZenSpire.fr e-commerce site.
 

Should the User request to object to the processing of their Personal Data, and inasmuch as these recommendations are an integral part of ZenSpire®'s service, the User may be invited to close their Personal Account (in the event that ZenSpire® is unable to provide the Services concerned without the processing in question).

13. Intellectual Property

The texts, comments, works, illustrations and images reproduced on the ZenSpire.fr website are reserved worldwide under copyright and intellectual property law.
 

As such, and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different or more restrictive provisions of the said code. Any total or partial reproduction of the ZenSpire.fr website is prohibited.

14. Retention of title

We reserve ownership of the goods and services until full payment of the price by the buyer.

Our claim applies both to the goods and their price if they have already been resold (Law 80-335 of May 12, 1980). Flat-rate recovery indemnity: €40. Penalties for late payment: 3 times the current legal interest rate.

15. Jurisdiction

These general terms and conditions of sale are governed by French law.


The court of the registered office of ZenSpire® has sole jurisdiction for any dispute arising from the application of these general terms and conditions of sale, without prejudice to our right to bring proceedings before any other competent court.
